1. About these Terms#
1.1 These Website Terms and Conditions (Terms) govern your access to and use of bellarinedrives.com.au and any related page, form, content or functionality operated by Bellarine Drives Pty Ltd (Bellarine Drives, we, us or our) (Website).
1.2 By accessing or using the Website, submitting an enquiry, or otherwise interacting with us through the Website, you agree to these Terms. If you do not agree, you must not use the Website.
1.3 These Terms concern the Website and direct interactions with Bellarine Drives. They do not replace the terms that apply to a booking made through Turo.
1.4 Nothing in these Terms excludes, restricts or modifies a right, guarantee, remedy or liability that cannot lawfully be excluded, restricted or modified, including under the Competition and Consumer Act 2010 (Cth) and the Australian Consumer Law (ACL).
2. Definitions#
In these Terms:
- ACL means the Australian Consumer Law in Schedule 2 to the Competition and Consumer Act 2010 (Cth).
- Approved Driver means a driver approved and recorded for a Trip in accordance with the Turo Rules.
- Booking means a vehicle reservation requested, accepted and recorded through Turo.
- Content includes text, photographs, vehicle descriptions, graphics, video, logos, layout, design, downloadable material and other content on the Website.
- Guest means a person who books or seeks to book a Vehicle through Turo.
- Turo means the peer-to-peer vehicle sharing platform available in Australia through turo.com and the Turo application.
- Turo Rules means the Turo terms of service, cancellation policy, community guidelines, prohibited-use rules, fee schedules, protection or earnings plan materials, trip-specific terms, Car Sharing Agreement and other applicable Turo policies, as updated from time to time.
- Trip means the period of a confirmed Booking, including any approved modification or extension.
- Vehicle means a vehicle listed by Bellarine Drives on Turo or displayed on the Website.
- you means a person who accesses or uses the Website or communicates with us through it.
3. Relationship with Turo#
3.1 Bellarine Drives is an independent vehicle host using Turo. Unless expressly stated by Turo, Bellarine Drives is not Turo, is not an agent or employee of Turo, and cannot bind Turo or alter Turo's decisions, systems or policies.
3.2 Turo provides the platform through which a Guest and host arrange a Booking. For each confirmed Booking, Turo makes available trip details and a Car Sharing Agreement summarising the reservation.
3.3 Turo is a third-party service. Your use of Turo is subject to the Turo Rules and Turo's privacy practices. You are responsible for reading and accepting the Turo Rules before making a Booking.
3.4 A reference or link to Turo does not amount to a guarantee by Bellarine Drives that Turo will be continuously available, approve a person or Booking, offer a particular protection arrangement, or resolve a matter in a particular way.
3.5 Turo states that it is not an insurance company. In Australia, protection plans may be provided through Turo Travels Mutual and are subject to separate eligibility criteria, exclusions, limits and documentation. Bellarine Drives does not provide personal financial product advice and makes no separate promise of insurance or protection.
4. Order of Priority#
4.1 If there is an inconsistency concerning a Booking, Trip, payment, cancellation, refund, fee, Approved Driver, vehicle eligibility, protection arrangement, incident, damage claim or Turo account, the following documents apply in descending order to the extent of that inconsistency:
- mandatory law, including the ACL;
- the confirmed trip details and Car Sharing Agreement issued through Turo;
- the applicable Turo Rules; and
- these Terms.
4.2 These Terms continue to govern use of the Website, Website Content, direct enquiries, intellectual property and other matters that are not specifically governed by the Turo Rules.
4.3 Nothing on the Website, in an advertisement, social-media post, email or informal conversation changes a confirmed Booking unless the change is accepted and recorded through Turo where Turo requires it.
5. Information Only; No Booking on the Website#
5.1 The Website provides general information about Bellarine Drives, our Vehicles, possible locations and experiences, and links or directions to Turo listings.
5.2 Displaying a Vehicle on the Website does not mean it is available for a particular date, location, Guest or purpose. Availability is determined through Turo and may change without notice.
5.3 An enquiry, quote request, expression of interest or message submitted through the Website does not create a Booking, hold a Vehicle, fix a price or oblige either party to proceed.
5.4 A Booking exists only when it has been accepted and confirmed through Turo. You must not treat an unconfirmed conversation, draft price, screenshot or Website display as a confirmed Booking.
5.5 To protect both Guests and Bellarine Drives and to preserve applicable Turo processes, we do not accept payment through this Website for a Turo Trip. Do not send card details, licence images or other sensitive identification through a general Website enquiry form or ordinary email unless we specifically and lawfully request it through a secure process.
6. Eligibility and Turo Account Requirements#
6.1 To book or drive a Vehicle, each person must satisfy the then-current eligibility, identity-verification, age, licensing, account and Approved Driver requirements imposed by Turo and applicable law.
6.2 Only an Approved Driver recorded for the Trip may drive the Vehicle. The primary Guest must not hand the Vehicle to an unapproved, unlicensed, suspended, impaired or otherwise ineligible person.
6.3 Bellarine Drives may decline to release a Vehicle where permitted by the Turo Rules or law, including where identity or licence checks cannot be completed, the person collecting the Vehicle is not the verified Guest or Approved Driver, the person appears impaired, or release would create a material safety or legal risk.
6.4 Any cancellation, no-show consequence, refund or host payment arising from an eligibility or verification issue will be determined under the Turo Rules and applicable law.
7. Vehicle Information, Images and Availability#
7.1 We take reasonable care to describe Vehicles accurately. Images may be illustrative or taken at a different time. Colour, accessories, cosmetic condition, software, tyres, wheels, exhaust components, trim and other details may appear differently due to lighting, maintenance, lawful modification, replacement or ordinary wear.
7.2 Vehicle specifications and performance figures may be sourced from manufacturers or third parties and are general information only. They are not an invitation to test performance, exceed speed limits, race, launch, skid, drift or use the Vehicle contrary to law or the Turo Rules.
7.3 A Vehicle may become unavailable because of safety, maintenance, damage, recall, mechanical, logistical, legal or other operational issues. Where this affects a confirmed Booking, the matter will be handled through Turo and in accordance with applicable law.
7.4 We may correct typographical errors, inaccurate descriptions or outdated Website information. We will not retrospectively change a confirmed Booking except as permitted by the Turo Rules or law.
8. Prices, Fees, Payments and Taxes#
8.1 Website prices, if displayed, are indicative only unless clearly stated otherwise. The final price and itemised charges for a Booking are those shown and accepted through Turo at checkout or in an approved Trip modification.
8.2 Turo may determine, collect or display trip prices, trip fees, delivery charges, protection-plan charges, deposits, young-driver fees, taxes, Extras, reimbursements, incidental charges or other amounts under the Turo Rules.
8.3 Bellarine Drives does not control every fee or exchange, payment, refund or authorisation process imposed or administered by Turo or a payment provider.
8.4 Unless Turo expressly permits otherwise, payments and reimbursements relating to a Trip must be processed through Turo. You must not ask us to conceal, misdescribe or move a Turo transaction off-platform.
8.5 Any discount, promotion or offer is subject to its stated conditions, availability and expiry. Unless expressly stated and permitted by Turo, promotions cannot be combined, transferred, redeemed for cash or retrospectively applied.
9. Cancellations, Changes, Extensions and No-Shows#
9.1 Turo's then-current cancellation policy governs cancellation windows, refunds, host earnings, no-shows, early returns, non-refundable bookings and relevant exceptions.
9.2 All requests to cancel, extend, shorten, change dates, alter delivery arrangements, add a driver or otherwise modify a Booking must be submitted and approved through Turo where required.
9.3 Sending Bellarine Drives a text message, email, social-media message or Website enquiry does not by itself cancel or modify a Booking.
9.4 A Vehicle must not be retained beyond the scheduled end of a Trip unless an extension has been requested and approved through Turo before the Trip ends. If approval is not obtained, the Guest must return the Vehicle on time and follow the Turo Rules.
9.5 Bellarine Drives may need to cancel or change arrangements for safety, maintenance, damage, recall, legal, force-majeure or other genuine operational reasons. Where a confirmed Booking is affected, we will communicate through Turo and the Turo Rules and applicable law will govern the outcome.
10. Collection, Delivery and Return#
10.1 The confirmed Turo trip details govern the agreed start time, end time, location and any approved delivery arrangement.
10.2 The Guest must complete all required check-in and check-out steps, including identity or licence verification and clear time-stamped photographs where required by Turo.
10.3 The Guest should inspect the Vehicle before departure and promptly report through Turo any material pre-existing damage, warning light, cleanliness issue, missing item or safety concern.
10.4 The Vehicle must be returned on time, to the approved location, secured, with keys and supplied items returned, and in the condition and with the fuel or charge level required by the Trip details and Turo Rules, subject to fair wear and tear and applicable law.
10.5 Instructions for remote access, keys, lockboxes or collection points are confidential and may be used only for the relevant Trip. You must not copy, publish or disclose them to an unauthorised person.
10.6 Personal property left in a Vehicle is at the owner's risk to the extent permitted by law. We will take reasonable steps to identify and facilitate return of found property, but may deal with unclaimed property in accordance with applicable law and the Turo Rules.
11. Safe, Lawful and Proper Vehicle Use#
11.1 During a Trip, the Guest and every Approved Driver must:
- comply with all road laws, licence conditions, parking rules and lawful directions;
- follow the Vehicle handbook, warning systems and reasonable safety instructions;
- use the correct fuel or charging method and monitor fluids, tyres, temperature and warning indicators where reasonably required;
- secure the Vehicle, keys and any access device when unattended;
- use child restraints that are lawful, suitable and correctly fitted; and
- stop driving and seek assistance if continued use may be unsafe or cause further damage.
11.2 Without limiting the Turo Rules, a Vehicle must not be used:
- by anyone who is not an Approved Driver;
- while impaired by alcohol, illicit drugs, medication, fatigue or any condition affecting safe control;
- for racing, speed trials, track use, drifting, burnouts, timed events, driver training or deliberate high-performance testing;
- recklessly, dangerously, unlawfully, abusively or in a manner likely to damage the Vehicle;
- to tow, push or carry a load unless expressly approved and lawful;
- off-road or on unsuitable, closed, flooded, restricted or prohibited roads unless the listing and Turo Rules expressly allow it;
- for unlawful activity, transporting prohibited goods, rideshare, taxi, delivery, sub-hire or other commercial use unless expressly authorised through Turo and lawful;
- outside the permitted geographic area or onto a ferry, island, racetrack or other restricted area contrary to the Trip details or Turo Rules;
- with smoking, vaping or an unauthorised animal in the Vehicle; or
- after a serious warning light, collision, tyre failure, overheating event or other condition makes continued driving unsafe.
11.3 References on the Website to power, sound, exhaust systems, driving character or performance are descriptive only and never authorise illegal or unsafe driving.
12. Fuel, Charging, Distance, Tolls, Fines and Incidentals#
12.1 Included distance, excess-distance charges, fuel or charging requirements, Extras and other Trip-specific inclusions are shown in the Turo listing or Trip details.
12.2 The Guest is responsible, to the extent provided by law and the Turo Rules, for tolls, parking charges, traffic or camera infringements, impound or administrative costs, excess distance, refuelling or recharging, cleaning, smoke or pet remediation, missing items and other eligible incidentals arising during the Trip.
12.3 Bellarine Drives will submit eligible reimbursement requests and supporting information through Turo within the applicable time limits. Turo's process determines the amount and outcome where Turo administers the charge.
12.4 You must not tamper with, obscure, remove or interfere with a number plate, toll device, odometer, telematics device, dash camera, tracker, safety system, key, immobiliser or other Vehicle equipment.
13. Breakdown, Accident, Damage, Theft and Emergency#
13.1 In an emergency, first ensure personal safety and contact emergency services on 000 where required.
13.2 The Guest must then follow the incident, roadside-assistance and damage-reporting steps in the Turo Rules and Trip materials, and notify Bellarine Drives through Turo as soon as reasonably possible.
13.3 Unless necessary for immediate safety, legal compliance or to prevent further loss, the Guest must not authorise repairs, dismantling, towing or expenditure without approval through the applicable Turo process or from Bellarine Drives.
13.4 The Guest must reasonably cooperate with incident and claim enquiries, including by providing accurate descriptions, photographs, licence and driver details, witness information, police event details and other relevant material.
13.5 Responsibility for damage, theft, loss, downtime, towing, storage and associated costs is determined by applicable law, the confirmed Trip, the Turo Rules and any applicable protection documentation. Nothing in these Terms expands a Guest's liability beyond what is lawfully recoverable or promised under those documents.
13.6 Bellarine Drives does not promise that a replacement Vehicle will be available. Any cancellation, substitution or support following an incident will be managed through Turo and applicable law.
14. Vehicle Technology, Location and Recording#
14.1 A Vehicle may contain manufacturer systems or lawfully installed devices that record or transmit information such as location, distance, speed, acceleration, braking, fault codes, battery status, security events or other operational data.
14.2 Such information may be accessed or used where reasonably necessary to locate or recover a Vehicle, respond to an emergency, protect safety or property, investigate suspected misuse, administer a Trip or claim, comply with law, or establish, exercise or defend legal rights, subject to applicable privacy and surveillance laws.
14.3 We will not use Vehicle technology to make audio or visual recordings of a Guest inside the passenger cabin unless this is expressly disclosed, lawful and handled in accordance with applicable requirements.
14.4 You must not disable or tamper with lawful safety, security, diagnostic or location technology. Any suspected defect should be reported promptly rather than altered.
15. Enquiries and Communications#
15.1 If you submit an enquiry, you must provide information that is accurate, current and not misleading.
15.2 We may respond using the contact details you provide. An enquiry response is informational and does not confirm a Booking.
15.3 Trip-related communications should be kept in Turo messaging where practicable so there is an accurate record available to the parties and Turo.
15.4 You must not use our forms, email or messaging channels to send unlawful, threatening, discriminatory, abusive, defamatory, fraudulent, malicious or unsolicited commercial material, or content that infringes another person's rights.
15.5 If you opt in to marketing, you may unsubscribe at any time using the method provided or by contacting us. Service messages relating to an enquiry or Trip are not marketing messages.
16. Privacy and Cookies#
16.1 We handle personal information in accordance with our Privacy Policy, applicable privacy law and, where relevant, the Turo Rules. Our Privacy Policy should be read with these Terms.
16.2 We may collect information you voluntarily provide, such as your name, contact details, enquiry and communication history, together with technical Website information such as IP address, browser type, device information, referral source, pages viewed and cookie data.
16.3 We may use this information to operate and secure the Website, respond to enquiries, administer our host operations, improve services, keep records, comply with law and communicate with you as permitted.
16.4 The Website may use necessary cookies and, if disclosed, analytics or preference cookies. Browser controls may allow you to restrict cookies, although some functions may then operate incorrectly. Where consent is legally required, we will seek it.
16.5 Do not submit another person's personal information unless you are authorised to do so and the disclosure is lawful.
16.6 Turo independently collects and handles information under Turo's privacy policy. Questions about Turo's handling of information should be directed to Turo.
17. Website Acceptable Use and Security#
17.1 You must not:
- use the Website unlawfully or for a fraudulent, misleading or harmful purpose;
- attempt to gain unauthorised access to the Website, server, account, data or connected system;
- introduce malware, malicious code, automated attacks or an unreasonable load;
- scrape, harvest or systematically extract Website Content or personal information except as permitted by law;
- bypass security, access controls, robots instructions or technical restrictions;
- impersonate another person or misrepresent an affiliation;
- interfere with the Website's operation or another person's use; or
- use our Content, brand or Vehicle images to create a false listing, fraudulent advertisement or misleading endorsement.
17.2 We may restrict or block access where reasonably necessary to protect the Website, users, Vehicles, our legitimate interests or compliance with law.
17.3 You are responsible for using up-to-date security controls and taking reasonable care when following links or sending information online.
18. Intellectual Property#
18.1 Unless otherwise stated, the Website and Content are owned by or licensed to Bellarine Drives and are protected by copyright, trade mark and other intellectual property laws.
18.2 We grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the Website for personal, lawful and non-commercial purposes connected with considering or managing a legitimate enquiry or Booking.
18.3 You must not reproduce, republish, sell, license, modify, distribute, frame, mirror, create derivative works from, or commercially exploit the Website or Content without our prior written consent, except where permitted by law.
18.4 Turo names, logos and platform materials belong to Turo or its licensors. Vehicle manufacturer names and marks belong to their respective owners. Their appearance does not imply sponsorship or endorsement of Bellarine Drives.
19. User Content, Reviews and Feedback#
19.1 If you submit a review, photograph, testimonial, suggestion or other content directly to us (User Content), you confirm that you have the right to provide it and that it is accurate, lawful and does not infringe another person's rights or privacy.
19.2 You retain ownership of your User Content. You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, edit for length or formatting, publish and communicate it for operating and promoting Bellarine Drives, but only to the extent reasonably contemplated when it was submitted or separately authorised by you.
19.3 We will not materially alter the meaning of a testimonial. You may ask us to stop using directly submitted promotional User Content, and we will take reasonable steps to do so for future use, subject to material already lawfully produced or required records.
19.4 Reviews submitted through Turo remain subject to the Turo Rules. We do not promise to publish every review submitted directly to us and may remove content that is unlawful, irrelevant, misleading, abusive or infringes rights.
20. Third-Party Links and Services#
20.1 The Website may link to Turo, maps, social media, payment providers or other third-party websites and services. Those services are operated independently and may have their own terms and privacy practices.
20.2 Links are provided for convenience and context. Except where expressly stated, we do not control or endorse third-party content and are not responsible for its availability, security or accuracy.
20.3 You should verify that you are using an authentic Turo or other third-party site before entering credentials or payment information. Report suspected impersonation or fraudulent Bellarine Drives listings to us promptly.
21. Website Availability and Accuracy#
21.1 We use reasonable care in operating the Website but do not guarantee that it will always be uninterrupted, error-free, current, compatible with every device or free from all harmful components.
21.2 We may suspend, withdraw or change Website functions for maintenance, security, legal or operational reasons.
21.3 General travel, tourism, distance, timing, road-condition, weather or local-business information is provided as a guide only. You must make your own current enquiries and allow appropriate travel time.
21.4 Nothing on the Website is legal, financial, insurance, mechanical or safety advice tailored to your circumstances.
22. Australian Consumer Law#
22.1 Our services come with guarantees that cannot be excluded under the ACL where the ACL applies. These may include guarantees that services will be provided with due care and skill, be fit for a disclosed purpose, and be supplied within a reasonable time where no time is fixed.
22.2 Nothing in these Terms is intended to exclude, restrict or modify those guarantees or any other non-excludable right or remedy.
22.3 If a limitation or exclusion in these Terms is inconsistent with a non-excludable right, the non-excludable right prevails and the limitation or exclusion is read down to the minimum extent necessary.
23. Liability#
23.1 To the maximum extent permitted by law, Bellarine Drives is not liable for loss arising solely from:
- your breach of these Terms, the Turo Rules or law;
- inaccurate or incomplete information supplied by you;
- an unapproved, unlawful or unsafe use of a Vehicle;
- the independent acts, omissions, systems or content of Turo or another third party, except to the extent we caused or contributed to the loss; or
- events outside our reasonable control that could not reasonably have been prevented or overcome.
23.2 To the maximum extent permitted by law, we exclude liability for indirect or consequential loss that was not reasonably foreseeable, including loss of opportunity, anticipated savings, business interruption or reputational loss. This does not exclude liability that cannot lawfully be excluded.
23.3 Any liability relating to a confirmed Booking or Trip is also subject to the allocation of responsibility and claim processes in the confirmed Trip documents, Turo Rules and applicable protection materials.
23.4 We do not exclude or limit liability for our fraud, wilful misconduct, or any death, personal injury or property damage to the extent caused by our negligence where that liability cannot lawfully be excluded or limited.
23.5 Each party must take reasonable steps to avoid or minimise loss.
24. Indemnity#
24.1 To the extent permitted by law, you indemnify Bellarine Drives against a third-party claim, loss, liability, damage or reasonable enforcement cost arising from your unlawful use of the Website, infringement of intellectual property or privacy rights, fraud, or deliberate breach of these Terms.
24.2 The indemnity is reduced to the extent that Bellarine Drives or another person caused or contributed to the relevant loss. It does not apply to the extent prohibited by the ACL, unfair-contract-term laws or other applicable law.
24.3 Trip-related damage, incidentals and claims are governed primarily by the confirmed Trip documents and Turo Rules rather than this Website indemnity.
25. Complaints and Disputes#
25.1 For a Booking, payment, cancellation, protection, incident, reimbursement or Turo account issue, first use the applicable Turo support or resolution process and keep relevant communication within Turo.
25.2 For a Website or Bellarine Drives complaint, contact info@bellarinedrives.com.au with your name, contact details, Booking reference if relevant, a clear description of the issue and the outcome sought. We will acknowledge and consider the complaint within a reasonable time.
25.3 The parties should first attempt to resolve a dispute in good faith. Nothing in this clause prevents either party from seeking urgent relief, using a Turo process, contacting Consumer Affairs Victoria or another regulator, or exercising a non-excludable legal right.
26. Changes to these Terms#
26.1 We may update these Terms to reflect changes to the Website, our operations, the Turo relationship, technology or law.
26.2 The updated version will be posted on the Website with a revised effective date. Changes apply prospectively from publication and do not retrospectively alter an existing confirmed Booking unless permitted by law and the Turo Rules.
26.3 If a material change affects a function for which consent is required, we will provide any notice or obtain any consent required by law.
27. Suspension and Termination#
27.1 You may stop using the Website at any time.
27.2 We may suspend or terminate access to the Website where reasonably necessary because of a breach, fraud, security risk, abuse, legal requirement or threat to persons or property.
27.3 Suspension from this Website does not itself cancel a confirmed Booking. Any Trip cancellation or account action must occur through Turo where required.
27.4 Provisions intended by their nature to continue after termination, including intellectual property, accrued rights, liability, dispute and governing-law provisions, survive.
28. General#
28.1 Governing law. These Terms are governed by the laws of Victoria, Australia. Subject to any right to bring a claim elsewhere under applicable consumer law, the parties submit to the non-exclusive jurisdiction of Victorian and Commonwealth courts sitting in Victoria.
28.2 Severability. If a provision is invalid or unenforceable, it is to be read down to the minimum extent necessary or severed, and the remainder continues.
28.3 No waiver. A delay or failure to exercise a right is not a waiver. A waiver must be in writing and applies only to the specific instance stated.
28.4 Assignment. You must not assign rights under these Terms without our consent. We may assign our rights and obligations as part of a genuine sale, restructure or transfer of the business, provided this does not reduce non-excludable rights.
28.5 Entire Website agreement. These Terms and our Privacy Policy constitute the agreement about use of the Website. They do not replace the confirmed Trip documents or Turo Rules applying to a Booking.
28.6 Interpretation. Headings assist reading only. The words including and for example do not limit what follows. The singular includes the plural and vice versa. A reference to legislation includes amendments and replacements.
